Welcome to IndiaMach (“we,” “our,” “us”). By accessing or using our website, platform, mobile application, or any services we provide (collectively, the “Platform”), you (“user,” “buyer,” “seller,” or “visitor”) agree to comply with and be bound by the following Terms & Conditions.

Please read these terms carefully before using IndiaMach.

1. Acceptance of Terms

By using IndiaMach, you confirm that:

• You have read, understood, and agreed to these Terms & Conditions.

2. About IndiaMach

IndiaMach is an online marketplace that allows users to:

• List new and used industrial machines.

• Buy machines directly from sellers.

• Connect with machinery dealers, manufacturers, and service providers.

IndiaMach is not a buyer or seller of the machines listed.
We only act as a platform to connect users.

3. User Accounts

To list or buy a machine, users must create an account.

Users agree to:

• Provide accurate and complete information.

• Maintain confidentiality of login credentials.

• Be responsible for all activities under their account.

We reserve the right to suspend or terminate accounts that violate policies.

4. Listings & Advertisements

Users who list machines (“Sellers”) agree that:

● All information must be accurate

This includes:

• Machine specifications

• Pricing

• Condition (new/used/refurbished)

• Images/videos

• Ownership details

● No fake, misleading, or fraudulent listings

We strictly prohibit:

• False claims

• Misrepresented machine conditions

• Stolen machinery listings

● IndiaMach may verify or remove listings

If a listing is suspicious, incomplete, or violates policy, IndiaMach may:

• Request additional documents

• Edit or hide the listing

• Permanently remove the listing

5. Transactions Between Users

IndiaMach is not responsible for:

• Quality or condition of machines

• Payment disputes

• Delivery or logistics

• Warranty or after-sales issues

All transactions are directly between buyer and seller.
Users must perform due diligence before purchasing.

6. Pricing and Payment

• IndiaMach does not interfere in pricing decisions.

• Sellers are solely responsible for setting and updating prices.

• Payments made offline or outside the platform are the user’s own responsibility.

IndiaMach may offer integrated payment options in the future, governed by additional terms.

7. Communication Between Users

Users may communicate through:

• Platform chat

• Email

• Phone

• WhatsApp (if shared)

Users agree not to misuse contact details or engage in:

• Spam

• Harassment

• Fraudulent offers

• Unsolicited promotions

8. Prohibited Activities

Users agree not to:

• Sell restricted or illegal machinery

• Post duplicate or spam listings

• Upload harmful files or viruses

• Copy or scrape IndiaMach content

• Publish defamatory or offensive content

• Attempt to hack or manipulate the platform

Violations may result in immediate account suspension.

9. Content Ownership

Content uploaded by users (images, descriptions, videos, documents) remains the property of the user, but by posting it, they grant IndiaMach:

• A non-exclusive, worldwide, royalty-free license

• To use, display, reproduce, and promote the content on the platform

IndiaMach owns:

• Logos

• Branding

• Website design

• Database

• Algorithms

• Content created by IndiaMach

Unauthorized use is prohibited.

10. Third-Party Links

IndiaMach may contain links to third-party websites for:

• Transport services

• Financing

• Spare parts

• Service providers

We are not responsible for the content or actions of these third-party websites.

11. Subscription & Paid Services

If IndiaMach offers premium listings or paid services:

• Fees must be paid in advance.

• No refund is provided unless stated otherwise.

• IndiaMach may modify pricing with notice.

12. Limitation of Liability

IndiaMach is not liable for:

• Any losses or damages from buying or selling machines

• Fraud or misrepresentation by users

• Machine performance issues

• Delays or failure in delivery

• Technical issues, downtime, or interruptions

Users agree to use the platform at their own risk.

13. Indemnification

Users agree to indemnify and hold IndiaMach harmless from any claims, losses, damages, or expenses arising out of:

• Breach of terms

• Misuse of platform

• Disputes between buyer and seller

• Violation of law

14. Changes to Terms

IndiaMach may update these Terms & Conditions from time to time.
Continued use of the platform signifies acceptance of the updated terms.

15. Termination

We may suspend or terminate accounts if users:

• Violate our policies

• Engage in fraudulent activities

• Post harmful or illegal content

• Harass other users

Users may also delete their account anytime.

16. Governing Law

These Terms & Conditions are governed by the laws of India, particularly the jurisdiction of Bangalore, Karnataka.
